Summary of Agreement
This Data Sharing and API Authorisation Agreement (“Agreement”) governs the electronic transmission of Head Impact Data from the HITIQ ProteQt application to authorised third-party software providers. By selecting “Join”, you (the “User”) agree and provide expressed consent thereby nominating for the data processing activities described herein.
1. Scope of Data Disclosure and Purpose
HITIQ will disclose specific Head Impact Data generated by the User to an external party via an Application Programming Interface (API). This data sharing is strictly limited to the following purposes:
- To facilitate enhanced athlete monitoring and performance analytics.
- To provide data-driven insights to support long-term brain health management.
- To enable third-party software integrations requested by the User.
2. Clinical and Diagnostic Disclaimer
The User acknowledges that the data provided via the API is for monitoring and informational purposes only.
- Non-Diagnostic: This data alone is not intended for the clinical diagnosis of concussion, traumatic brain injury (TBI), or any other medical condition.
- Medical Consultation: The User is advised to seek professional medical counsel for any health-related assessments.
- HITIQ is not a healthcare provider, and the API output does not constitute medical advice.
3. Transfer of Responsibility and Data Residency
Once data is transmitted to an external party via the API, that data is no longer within the effective control of HITIQ.
- Security: All transmissions are protected using industry-standard encryption protocols. HITIQ utilises Amazon Web Services (AWS) infrastructure, with primary databases hosted in your local region to ensure secure storage.
- Residency: The User acknowledges that the authorised external party may store or process this data on servers located outside of Australia, and HITIQ shall not be held liable for any subsequent handling, storage, or security breaches of the data by the external party.
- Third-Party Responsibility: The external party becomes the primary data holder upon receipt.
- User Due Diligence: The User is responsible for reviewing the privacy policy and terms of the external party before authorising the link.
4. Restrictions on Commercialisation
This data sharing is subject to the HITIQ Terms and Conditions. The User and the authorised external party are strictly prohibited from:
- Selling, leasing, or otherwise commercialising the raw data or derived insights.
- Using the API for any purpose other than the non-commercial monitoring of athlete health and safety.
- HITIQ reserves all intellectual property rights in the underlying algorithms and data structures.
5. Right to Terminate Access
HITIQ maintains absolute discretion over the stability and security of its platform. HITIQ reserves the right to suspend or cancel the API link to any external party at any time, without prior notice, should HITIQ deem it necessary for security, regulatory compliance, or technical integrity.
6. Anonymisation and Research
To advance global understanding of sports-related brain injuries, HITIQ may:
- De-identify Data: Permanently remove personal identifiers from the User's data set.
- Extract for Research: Use anonymised, aggregated data for internal and external research purposes aimed at improving brain health protocols and athlete safety products.
- Such data will no longer constitute "Personal Information" under the Privacy Act 1988 (Cth).
7. User Rights and Data Management
The User maintains the right to access their personal information held by HITIQ and to request corrections. Consent for this API data share may be withdrawn at any time via the ProteQt app settings/manage data share page; however, withdrawal of consent does not affect data already transmitted to external parties.
